Sex Crimes include charges such as Sexual Assault, Aggravated Sexual Assault, Aggravated Sexual Assault of a Child, Indecency with a Child, Continuous Sexual Abuse of a Child, and numerous other sexually related offenses. Few crimes carry the stigma and severe consequences that go along with a charge and conviction in a sex case.
It is often very difficult to distinguish between a legitimate outcry of sexual abuse and a false allegation. Generally, an investigation into an allegation of sexual abuse starts with an accusation from a single person. It is common that a police and prosecution investigation of such an allegation uncovers no evidence beyond the initial accusation. Nonetheless, cases are frequently filed with no evidence beyond the word of one person.
This is an incredibly frustrating and terrifying experience for the person accused. The accusation of sexual abuse alone can destroy a family and cause an accused person to lose a job or career. Ultimately, the accused may face the possibility of many years in prison and the requirement to register as a sex offender.
But the news is not all bad for the accused. There are many opportunities for an experienced defense attorney to get a sex case dismissed, win at trial, or get an otherwise favorable result. It can be difficult for prosecutors to win a sex case at trial because these cases are often charged without physical evidence, scientific evidence, or corroborating witnesses. As a result, it can be hard for any person (attorney, judge, or juror) to know which accusations are legitimate and which are false. These difficulties can be exacerbated by the fact that allegations of sexual abuse are often made under suspect or usual circumstances. Finally, the law requires that the prosecution prove these difficult and sometimes confusing cases beyond a reasonable doubt. This is not always easy for the State to do.
